What should I know before hiring a job with drones?
If you need to hire the services of a professional for a drone job, you should contact a Drone Operator, a name that assigns the current legislation to companies and freelancers authorized to perform work with remotely piloted aircraft (RPAS).
Before starting the hiring of this company or professional has to ensure that all documentation and insurance are in order, as it is the only guarantee for the customer in the case in which there was an incident during the flight. You should bear in mind that hiring a drone pilot is not the same as hiring a Drone Operator, being a drone pilot does not prove to be an Operator. So you should check that it is enabled or authorized in AESA.
Keep in mind that AESA is the only official body in Spain with powers to authorize and enable Drone Operators. Neither municipalities, nor regional governments, nor associations have any competence to authorize any type of operation with drones. To check if this company or professional is enabled you can ask for the registration number or name and check it in the official list of operators published by AESA.
Another requirement to comply is the prior notification and responsible declaration stamped by AESA. It is a document that the company or professional Drones Operator has to cover and send to AESA and where it will include, among others, the work that can be done with drones, the aircraft that can pilot and the information about the pilots that can operate.
Finally, it is essential that the company has third-party liability insurance in force. The law requires that each drone operated by the professional or the company have a liability insurance covering a minimum of € 300,000 per claim.

Can I have legal problems if I do not contract a Drone Operator to drone works?
The answer is definitely YES. When contracting the services of a drone, you must know that as a contracting party you will be affected by the subsidiary liability in case of the non-solvency of the contracted party. The same applies to professionals and companies operating Drones. In case of sanction and non-solvency by the Operator, AESA may claim payment of the sanction from the contracting party.
It is therefore vital to ensure that when a professional or operator of Drones is hired, it has all the documentation in order and compulsory insurance at the time of payment.
